The allegation arose after former FBI director James Comey testified that Trump had asked him to drop an investigation a few times into former National Security Adviser Michael Flynn.
On Sunday, the short straw was drawn by attorney Jay Sekulow, a member of the personal legal team Trump has begun assembling to defend him against possible accusations of obstruction of justice in the investigation of Russian meddling in the November presidential elections.
Not surprisingly, most of the hosts interviewing Sekulow on Sunday morning started by taking the president at his word that he is "being investigated".
But Sekulow said Trump "cannot be investigated, or certainly can not be found liable, for engaging in an activity that he clearly has powers to do under the Constitution".
If true, the claims would represent a major turning point in the investigation, which until now has focused on the possibility of Russian interference with the election; according to those officials, the direction of the investigation changed after the firing of former FBI Director James Comey.
Separately, a former White House lawyer, who spoke on condition of anonymity, said there was nothing stopping Trump or his lawyers from asking Mueller whether Trump was under investigation.Mueller would be allowed, though not required, to answer that question, unless it involved material before a grand jury, the former White House lawyer said.The lawyer also said it was unlikely that any obstruction probe would not examine Trump."It's inconceivable he's not under investigation in the obstruction investigation", the lawyer said.
"He s not afraid of the investigation - there is no investigation. there is not an investigation of the president of the United States, period". "We're a nation of laws that apply equally to everyone, a lesson the president would be wise to learn", she said. Trump likely will become more unhinged as headlines dog him day after day, a parade of witnesses troop in to talk to the special counsel and the investigation metastasizes.
Trump at first attributed Comey's firing to a recommendation by Deputy Attorney General Rod Rosenstein for his handling of an investigation past year into the use of a private email server by Trump's defeated challenger, Democrat Hillary Clinton.
With no limits to the investigation, and with the president's pique leading to ready rationales for expanding the probe, Mueller and his team will inevitably find something. "He can not in a Twitter statement include all of that in there, but "The Washington Post" statement came out that morning", he said.
While aides have advised Trump to stay off Twitter, the president continued to weigh in Sunday as he spent the weekend at Camp David, the government-owned presidential retreat in Maryland. "And I want to be very clear about this - the president is not and has not been under investigation". Rather, they are notified after evidence is developed.
"The tweet from the president was in response to the five anonymous sources that were purportedly leaking information to The Washington Post about a potential investigation of the president", Sekulow said.
Senator Marco Rubio, who lost the Republican primary election to Trump, called for a "full and credible investigation".
A source familiar with the matter told CNN's Evan Perez that investigators for Mueller would speak with Director of National Intelligence Dan Coats and National Security Agency Director Mike Rogers.
