UN orders Pakistan not to execute Indian man accused of spying

Talking to a news channel, he said Pakistan would form a new team of lawyers to present Pakistan's stance vigorously in the case.

The Pakistan's Foreign Office said on Thursday that the ICJ has no jurisdiction over the county's national security matters, which in this instance was the execution of Jadhav.

The ICJ on Thursday ordered Pakistan to halt the execution of Indian spy Kulbhushan Jadhav until a final decision in the proceedings.

Ronny Abraham, the Hague-based court's president, also asked Pakistan to inform the tribunal that it will implement the ruling, and stressed that ICJ decisions are binding on all state members.

Pakistani representative Mohammad Faisal on Monday showed judges a copy of an Indian passport he said Jadhav was carrying at the time of his detention, which bore the name Hussein Mubarak Patel, calling it an "obvious indication of covert and illegal activity". He was convicted last month by a military court and sentenced to death.

India, meanwhile, asserted the ruling is binding on Pakistan, calling it "unanimous" and "unambiguous".

Shaiq Usmani, a retired judge of Pakistan's Supreme Court, told the media that Jadhav's case will go on in Pakistan until the ICJ gives it final decision.

Marriyum said Pakistan fought the case before the ICJ professionally, urging the opposition parties to stop politicising the matter.

India said it took the rare step of appealing to the United Nations court after Pakistan denied 16 requests for its diplomats to visit Jadhav, and because it felt Jadhav's execution could be imminent.

"The ICJ has stated that by way of provisional measures, the status quo be maintained in the case of Jadhav".

During the hearing, India's lead attorney, former solicitor general Harish Salve said the country feared Jadhav could be executed even as his case was being heard by the ICJ. Indian lawyers argued that those restrictions amounted to a breach of the 1963 Vienna Convention on Consular Relations. India says he was kidnapped by Pakistan while he was in Iran. Pakistan was also accused of denying Jadhav a fair trial in violation of worldwide human rights laws.

India's case had no substance, the Pakistani government said.
